You must be eighteen or over to register as a member of MAGIC POTIONS MERCHANDISE or use the Website. Membership in the Service is void where prohibited. By using the Website, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.
This Agreement will remain in full force and effect while you use the Website and/or are a Member. You may terminate your membership at any time, for any reason by following the instructions on the Resign pages in Account Settings, or upon receipt by MAGIC POTIONS MERCHANDISE of your written or email notice of termination. MAGIC POTIONS MERCHANDISE may terminate your membership for any reason, effective upon sending notice to you at the email address you provide in your application for membership, or such other email address as you may later provide to MAGIC POTIONS MERCHANDISE. If MAGIC POTIONS MERCHANDISE terminates your membership in the Service because you have breached the Agreement, you will not be entitled to any refund of unused subscription fees. Even after membership is terminated, this Agreement will remain in effect. Even after this Agreement is terminated, certain provisions will remain in effect, including sections 4, 5, 7 and 9-14 of this Agreement.
3. Non Commercial Use by Members.
The Website is for the personal use of individual Members only and may not be used in connection with any commercial endeavors. Organizations, companies, and/or businesses may not become Members and should not use the Service or the Website for any purpose. Illegal and/or unauthorized uses of the Website, including collecting usernames and/or email addresses of members by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or linking to the Website will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.
4. Proprietary Rights in Content on MAGIC POTIONS MERCHANDISE.
MAGIC POTIONS MERCHANDISE owns and retains all proprietary rights in the Website and the Service. The Website contains the copyrighted material, trademarks, and other proprietary information of MAGIC POTIONS MERCHANDISE, and its licensors. By posting Content to any public area of MAGIC POTIONS MERCHANDISE, you automatically grant, and you represent and warrant that you have the right to grant, to MAGIC POTIONS MERCHANDISE an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.

f. contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
g. provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;
h. provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
i. solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and
j. engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.
k. You must use the Service in a manner consistent with any and all applicable laws and regulations.
l. You may not include in your Member profile any telephone numbers, street addresses, last names, URLs or email addresses.
m. You may not engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service. You may not transmit any chain letters or junk email to other Members. Although MAGIC POTIONS MERCHANDISE cannot monitor the conduct of its Members off the Website, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect our Members from such advertising or solicitation, MAGIC POTIONS MERCHANDISE reserves the right to restrict the number of emails which a Member may send to other Members in any 24-hour period to a number which MAGIC POTIONS MERCHANDISE deems appropriate in its sole discretion.

8. Member Disputes.
You are solely responsible for your interactions with other MAGIC POTIONS MERCHANDISE Members. MAGIC POTIONS MERCHANDISE. reserves the right, but has no obligation, to monitor disputes between you and other Members.
MAGIC POTIONS MERCHANDISE is not responsible for any incorrect or inaccurate Content posted on the Website or in connection with the Service, whether caused by users of the Website, Members or by any of the equipment or programming associated with or utilized in the Service. MAGIC POTIONS MERCHANDISE is not responsible for the conduct, whether online or offline, of any user of the Website or Member of the Service. MAGIC POTIONS MERCHANDISE assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user or Member communications. Cash on Delivery Terms & Conditions
The availability of Cash on Delivery for purchases made on this site is subject to the Cash on Delivery terms & conditions below which are separate from and in addition to the Conditions of Use that govern your use of the Site, including each order that you place.
- Cash on Delivery can be used as payment method only for orders shipped within the Philippines.
- The minimum purchase required to avail COD is PHP 500.00 worth of any Magic Potions product.
- Items that are purchased under COD basis will be delivered to the mailing address you specified upon checkout. Please make sure that you provide the correct and complete address. Magic Potions, Full Philippines and courier will not be liable for delivery failures due to incorrect address.
- Our COD provider will deliver your item and collect payment. Please ensure the item is paid in full.
- Please try to be ready with the exact amount. We cannot guarantee that the courier will have change all the time.
- COD purchases have no specific delivery time frame due to numerous factors such as route, weather, etc. Delivery of items is from Mondays to Saturdays only, as per the guidelines set by LBC.
- The courier will have two attempts to deliver your order. If you'll not be available to personally receive the item, we highly recommend leaving a signed Authorization Letter and two (2) of your valid IDs to your representative who will receive the package in your behalf.
- Addresses recorded with unclaimed products will be blacklisted on our database.
- We can not guarantee that the courier will call or send sms upon delivery, so please utilize the tracking number that will be provided to check the status of your item.

- The buyer cannot open the package before submitting the transaction amount to the courier agent.
We reserve the right to make changes to Cash on Delivery, our policies, and these terms and conditions at any time. You will be subject to the policies and terms and conditions in force at the time that you use Cash on Delivery, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable by a court, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
Orders are sent via DHL for 2 to 5 working days shipping. Shipping cost will be charged depending on the weight of the order and its destination.

Orders from African countries take more than a month or 2 due to indirect postal connections.

INTERNATIONAL SHIPPING AND HANDLING REMINDERS
To ensure a fast, expedited delivery, please check that delivery address is correct and the payment has been processed or successful. Magic Potions Online Shop will not be held liable for any shipments sent to the incorrect address provided by the customer. We only deliver to the address indicated in your Magic Potions Online Order Email.
International Orders are shipped via DHL which delivers the package in 2 to 5 working days. The shipping charge will appear in your shopping cart as you finalize your order BUT before your credit card is charged you can review this amount.
There will be an unlikely event where shipping will be delayed due to strict customs and post office clearance that would need your signature to release the item. Shipping is tracked for the safety of your products, the tracking number will be provided once the shipment has been made and it could be tracked through a website. THE BUYER IS RESPONSIBLE for all taxes, duties, tariffs and customs laws in Buyer’s country.
INTERNATIONAL SHIPPING REMINDERS
1) Orders made between 12mn and 2pm (Philippine Time) will be shipped on that same day. Orders made after 2pm will be shipped the next day. Orders made after 2pm during Fridays will be shipped on Mondays. Please be considerate about our time difference.
2) Orders made after 2pm and a day before any LEGAL PHILIPPINE HOLIDAY will be shipped immediately on the next working day.
3) We cannot be responsible for any tariffs, CUSTOMS RESTRICTIONS or other regulations that apply in countries outside Philippines. We encourage you to speak with your customs office if you have any questions.
4) If for any reason the package is seized by Customs Officials, we will not issue a refund unless all products are returned to us in good condition. If the package is returned to us by Customs Officials, the customer is still responsible for any shipping charges. Only the amount paid for the products will be refunded.
5) The customer is responsible for any duties or taxes that may apply. It is also the customer’s responsibility to negotiate for the release of their package in the event that it is held up by customs. We can provide necessary paper works/certification, if availabble, to help with the negotiation.
6) It is customers’ responsibility to track their orders through your countries respective Postal Service Customs or Website, if available. You can email us if you are having problems tracking your orders or if there are any delays.
7) Return To Sender (RTS) items due to the following reasons will be shipped again provided that you pay another shipping fee.
- Address not existing
- Person unknown at the address
- Address vacant
- Any other reason in which the customer is solely liable
INTERNATIONAL SHIPPING POLICY
Our corporate and shipping offices are open from 9am to 6pm Monday through Friday and are closed Saturday and Sundays. Our shipping office closed on all government observed holidays.
We use the DHL for 2 to 5 working days shipping. Business days are Monday through Friday and on non-government observed holidays. Weekends are Saturday and Sundays. Under normal circumstances, orders placed will ship the following business day. Orders placed on the weekend will ship at the next earliest business day which is usually the following Monday.
International Deliveries Reminders
- Customs restrictions and warranty issues prevent us from shipping to every international location. Customers are responsible if there will be any additional customs fee. We cannot ship overnight to international addresses; it takes 2 to 5 working days. The shipping cost depends on the weight of the package and country of destination. The shipping charge will appear in your shopping cart as you finalize your order BUT before your credit card is charged so you can review this amount. Upon shipment of your order, you will be emailed a shipment confirmation so you can confirm that your order has been shipped. The Buyer is responsible for all taxes, duties, tariffs and customs laws in Buyer’s country..
- Do not order items that are illegal to import into your country. Laws vary from country to country. It is your responsibility to check with your Customs office to see if your country permits the import of our products. Generally speaking, we have never encountered problems with customs when shipping to most countries worldwide.
- If the package is seized by Customs for any reason and returned back to us, we will issue you a prompt refund, less the shipping costs. If it is not returned back to us, we cannot issue you a refund. Most orders held by customs are for the purpose of charging import duties and Customs fees. We have had such troubles in less than 1% of our international shipments. If you are not sure, please contact the Customs Office in your country before ordering, as we are not responsible for such charges.
- It is customers’ responsibility to track their orders through your countries respective Postal Service Customs or Website, if available. You can email us if you are having problems tracking your orders or if there are any delays.
- Prepayment is required. Payment must be by credit card, Bank transfer or Western Union. Refunds are not available for wholesale purchases.
- We are not responsible for carrier transit time. This information is provided by the carrier and excludes weekends and holidays. Note that transit times may vary, particularly during peak periods or in climate weather conditions, and that delivery times frames will need to be extended for any processing time.
Cancellations / Return to Vendor Items
Cancellations must be made before we send the order. If the order has not been shipped, a refund will be issued by the same method of payment the order was originally charged. If a cancellation is placed after the order has been shipped, it is the customer‘s responsibility to send it back to us. Once we received the package, a refund will be issued. Shipping and handling charges are non-refundable. All refunds are processed within 5 business days. We reserve the right to cancel any order at any time.
Return To Sender (RTS) items due to the following reasons will be shipped again provided that the client will pay the reshipping fee.

- Person unknown at the address
- Address vacant
- Address Undeliverable
- Any other reason in which the customer is solely liable
We DO NOT accept international orders by phone. You can call us if you have concerns other than placing an order and/or payment. If you intend to call us, please be reminded that all in information about us, products and pricing are already in our website. We always improve and make our website more accessible and user-friendly please try to read them so we can save you effort, time & money in calling us for information that is already provided.
